Effective 7th July, 2023

This Subscription Agreement (this “Agreement”) is entered into by and between Tender Response Limited company with its principal office at 20 Valley Road, Burghfield Common, Reading, Berkshire, RG7 3NF (“Tender Response”) and the entity or person agreeing to the Agreement (“Customer”), each a “Party” and collectively the “Parties.” The Agreement is effective as of the earlier of the date of last signature of the Parties on the initial Order Form (“Effective Date”).

Tender Response will onboard the Customer to Tender Finder and by doing so enlist the Customer onto open Public Procurement Portals where their services are purchased by the public or third sector.

Tender Response will control all procurement portal login details on behalf of the Customer. All details will be kept securely. Information will be kept until 6 months after the subscription ends and then will be fully deleted from the Tender Response systems.

Tender Response used CPV codes as defined by the Gov.UK website which may receive updates from time to time. Tender Response will add more CPV codes to the Customer procurement portal profile than are necessary.

It is the procurer (Council, Trust, Public Sector procurer) to attribute the correct CPV code to their announcement. Should an incorrect CPV code be used, it may result in the procurement announcement being missed by Tender Response. Tender Response is not liable for missing procurement announcements.

On occasion, Tender Response may recommend that the Customer applies for access to frameworks. Any application support is excluded from the Tender Finder subscription although once the Customer has been accepted to the framework, the framework will be monitored by Tender Response through their Tender Finder subscription.

The initial order is deemed at the point at which the Customer starts the Tender Finder Subscription.

The subscription is a monthly payment collected via standing order. Changes to plans can be made at any time by emailing accounts@tenderresponse.co.uk.

There is no minimum subscription term. Refunds are not supported. Cancellations take effect from the next renewal. Cancellations can be requested by emailing accounts@tenderresponse.co.uk.

Should the subscription payment be cancelled by the Customer, this will be deemed as cancellation of the Tender Finder service by Tender Response and the service will cease.

Invoices and receipts can be requested from accounts@tenderresponse.co.uk.

Billing queries to be sent to accounts@tenderresponse.co.uk.

Governing Law and Venue. The Agreement and any action related thereto will be governed and interpreted by and under the laws of the United Kingdom, without giving effect to any conflicts of laws principles that require the application of the law of a different jurisdiction. Customer hereby expressly consents to the exclusive, personal jurisdiction of, and venue in the United Kingdom.
